老年人只需拿上身份证去营业厅办理一张电话卡，再把电话卡交给保健品店，就能领到50元……这一幕在四川绵阳一家保健品店上演。然而，在老人将办理的电话卡交给老板后不久，部分电话卡却被查出涉嫌多起诈骗案。原来，保健品店老板在金钱诱惑下，让店内老年顾客办卡后，进行收购并出售。近日，金某、刘某、王某因犯帮助信息网络犯罪活动罪而分别获刑。

据介绍，金某找到刘某以每张150元至200元的报酬让其帮忙收购电话卡。而刘某将目标锁定在了开保健品店的王某身上。
王某的店中有很多老年顾客，在刘某的金钱诱惑下，王某开始向店里老年客户宣传，办一张电话卡就送50元。老年人见能免费领50元，于是带着身份证去办理电话卡。就这样，金某通过刘某从王某处收购电话卡共30余张。
事后不久，东窗事发。警方在侦破一起电信诈骗案时发现，金某、刘某、王某收购出售的电话卡中，部分老年人办理的电话卡涉嫌多起诈骗案，涉案资金达20多万元。
近日，绵阳涪城法院作出判决，金某犯帮助信息网络犯罪活动罪，判处有期徒刑七个月，缓刑一年，并处罚金人民币三千元。王某犯帮助信息网络犯罪活动罪，判处有期徒刑七个月，缓刑一年，并处罚金人民币二千五百元。刘某犯帮助信息网络犯罪活动罪，判处有期徒刑六个月，缓刑一年，并处罚金人民币二千元。并对三人的全部违法所得予以没收。
《中华人民共和国反电信网络诈骗法》第三十一条规定，任何单位和个人不得非法买卖、出租、出借电话卡、物联网卡、电信线路、短信端口、银行账户、支付账户、互联网账号等，不得提供实名核验帮助；不得假冒他人身份或者虚构代理关系开立上述卡、账户、账号等。
法官提醒：
电信诈骗的电话一般来自境外，诈骗团伙需要借助境内的电话卡将境外来电转变成国内座机号码，隐匿真实位置，降低被害人防范意识。其中买卖、出借、出租身份证、银行卡、手机卡都有可能为他人实施电信诈骗提供便利，成为犯罪团伙的帮凶。出借或出售电话卡可能受到停机、不能办理新入网业务等惩戒，严重的话还会受到行政处罚或者刑事处罚。请注意保护个人信息安全，切勿将身份证、银行卡、手机卡、U盾等出租、出借、出售给他人，以免成为网络犯罪的帮凶。
