“针对不满16周岁的未成年人办理电信业务，要有其法定代理人在场，并如实登记未成年人和法定代理人证件信息，现场拍摄留存法定代理人照片。”近日，监利市科学技术和经济信息化局针对监利市检察院未检部门前期制发的检察建议进行了上述回复。
2023年，监利市检察院未检部门在办理的多起未成年人帮助信息网络犯罪案件中发现，部分未成年人不满十六岁，却自己独立前往营业厅办理电话卡，并将新办理的电话卡销售给他人，为电信诈骗分子提供电话卡支持。
电信诈骗分子在本市多地架设运行了一种为“上线”提供信号中转服务的自动拨号设备，主要操作办法是用两部手机分别下载语音端、插卡端APP，在插卡端APP手机内插入未成年人的SlM电话卡，用对录线将两部手机相连，输入上家提供的账号，上家就可以远程操控手机拨打诈骗电话，被害人电话显示的则是插卡端的电话卡号，而不会显示诈骗分子的电话卡号。
针对未成年人办理电话卡的问题，工业和信息化部官网曾回复，根据《民法典》和《电话用户真实身份信息登记规定》有关要求，针对未满16周岁及其他无民事行为能力的用户，应由其法定代理人在电信业务经营者自有营业厅代为办理，电信业务经营者应如实登记用户和法定代理人证件信息，并现场拍摄留存法定代理人照片。
监利市科学技术和经济信息化局对电信业务具有监督管理职责，但该局对电信营业厅违规为未成年人办理电话卡的情况，未依照前述相关规定进行监督管理，存在怠于履职的情况，导致电信网络诈骗案件难以查证。
2023 年9月8日，监利市检察院依法向监利市科学技术和经济信息化局发出社会治理类检察建议，建议该局加强对辖区内电信业务经营者的监督管理、法律培训，督促相关营业厅落实未成年人办理电话卡的相关要求。
监利市科学技术和经济信息化局高度重视，安排分管信息化工作领导及相关股室牵头推进检察建议办理工作，对电信营业厅在监管制度、惩戒措施、培训宣传方面开展了工作，积极协调通信运营商依法依规为未成年人办理电信业务，有效规范电信网络诈骗案件发生。2023 年9月27日，监利市科学技术和经济信息化局将相关整改情況及时进行了回复。
下一步，监利市检察院将积极履行法律监督职责，切实加强未成年人司法保护力度，持续跟踪检察建议落实情况，做好未成年人权益保护和犯罪源头预防工作，为未成年人健康成长筑牢安全保护屏障。
