“请再次确认一下协议内容，另外因为您还未满18周岁，我们需要额外做一项登记……”近日，重庆市丰都县检察院在对辖区电信业务经营者开展“回头看”时，恰好遇到一名未成年人在父母的陪伴下办理新卡。工作人员正反复向他们介绍着相关协议，并进行台账登记。而此次回访，还得从5个月前该院办理的一起诈骗案说起。
用一部手机登录诈骗软件、拨通上家语音，再用另一部拨打被骗对象电话，同时开启免提，其余流程交给上家。2023年12月，一名冒充某学校“技术老师”的不法分子盯上17岁的小天（化名），在取得其信任后，向其推销起非法赚钱的门路。小天抱着侥幸心理，按他的指示拨打完电话，当天就收到1000元“报酬”。
“办卡很简单，只需要签几次字就行，我也没看到底签了什么。”由于系统检测到账户异常，小天的电话卡第二天就被封停，“技术老师”再次支起招，鼓动小天去办理新卡。尝到甜头的小天也不甘心丢掉这份“工作”，随即到营业厅办理了2张正卡和2张副卡。激活新卡后，小天再次拨通电话，上家很快骗取被害人杨某某2万余元。
“一学就会，当天拿钱；打打电话，日薪上千。没想到这一切竟成真了！”看着手机里的1900元转款，小天十分欣喜，可他未曾料到这份“好工作”不只是换来了高薪，还等来了民警上门。2023年12月，公安机关将该案移送丰都县检察院审查起诉。
在审查起诉阶段，检察官对小天开展了训诫教育。今年3月，丰都县检察院综合考虑小天的从犯地位、社会危害程度、认罪认罚表现等情节，依法对其作出附条件不起诉决定，考验期六个月。
在考验期内，丰都县检察院“检爱家倍护未队”多次来到小天家中，开展家庭教育指导工作，引导小天的父母做好家庭教育，帮助小天迷途知返。
检察官在办案中发现，出租、出借、出售电话卡是未成年人涉嫌电信网络诈骗犯罪的主要方式，尤其是16周岁至18周岁的未成年人无需监护人陪同，只要出示身份证即可一次性办理多张电话卡。
在调查过程中，办案检察官还发现，运营商在业务办理流程中缺乏对办卡意图的有效审核、对风险及法律责任的明确告知，相关职能部门未动态监管未成年人批量办理电话卡等问题。
今年4月，丰都县检察院向有关部门制发检察建议，建议其进一步规范电话卡办理工作，重点关注未成年人异常办卡情况，建立内部信息统计、异常线索移交和信息共享等机制。
此外，丰都县检察院在梳理近年来所办涉未成年人电信网络诈骗案件时发现，除电话卡外，利用未成年人银行卡实施电信网络诈骗犯罪的案件也层出不穷。丰都县检察院随即组织该县公安局、经济和信息化委员会、中国人民银行丰都支行、县教委召开关于未成年人办理“两卡”登记管理的商讨会。五家单位在会上达成共识，签署了《加强未成年人办理“两卡”登记管理的实施办法》，对核验登记、账户监测、信息衔接、线索通报、普法教育、跟踪问效等进一步明确细化。
